Technical Guidance & Permits

The Governor’s Office published an updated agency by agency Catalog of Nonregulatory Documents for each agency-- primarily technical guidance, Secretary’s letters and similar documents on implementing programs, -- in the August 20 PA Bulletin starting on page 5185.

Individual environmental agencies start on these pages--

-- Department of Agriculture - 5188

-- Department of Conservation and Natural Resources - 5202

-- Department of Environmental Protection - 5241

This listing is not forward-looking.  It does not tell the public what guidance is in development like DEP’s Non-Regulatory and Regulatory Agendas do, for example.

DEP has technical guidance documents available through its eLibrary.

The Department of Environmental Protection published notice in the August 20 PA Bulletin of final technical guidance on the Beneficial Use of General Permit Materials at Active Coal Mines and Log Treatment Of Viruses Demonstration Guidance (Drinking Water).

DEP ID: 563-2112-001. Title: Beneficial Use of General Permit (GP) Materials at Active Coal Mines. Descrip- tion: This guidance explains how the Bureau of Mining Programs implements the beneficial use of materials authorized by a Bureau of Waste Management General Permit for a site covered under a coal mining permit. It clarifies the procedure for obtaining approval from the Department to use these materials for coal mine reclamation and the guidelines for making the approval determination. The guidance was published as draft at 46 Pa.B. 3030 (June 11, 2016). No comments were received. No changes were made to the draft document.  Contact: Questions regarding this technical guidance document should be directed to Sharon Hill at 717-787-6842 or by sending email to: shill@pa.gov.

DEP ID: 394-2125-002. Title: 4-Log Treatment of Viruses Demonstration Guidance (Drinking Water). Description: The subject guidance document was developed to help all community water systems and some noncommunity water systems to comply with the Pennsylvania Groundwater Rule that was promulgated on December 26, 2009. The draft document has helped water systems in submitting uniform information for analysis of 4-Log demonstration under the Pennsylvania Groundwater Rule. The compliance dates for community water systems varied by the size of the system and has passed. The document is now used primarily by noncommunity systems on an as needed basis. The revisions include: (1) changes to the titles and form numbers for some of the forms; (2) minor changes to address comment from International Ultraviolet Association (IUA); (3) minor changes to incorporate responses to the comments included in the comment and response document; (4) reference to e-library link for various forms instead of inclusion of those in the guidance document; and (5) inclusion of IUA's comment and response in the comment and response document.

This guidance was published as draft at 41 Pa.B. 307 (January 8, 2011) for a 30-day comment period. Comments were received from IUA and incorporated within the comment and response document. This technical guidance document has been renumbered from 385-2125-001 to reflect a Departmental reorganization.

Contact: Questions regarding this technical guidance document should be directed to David Mittner at 717-787-9633 or or by sending email to: dmittner@pa.gov.
