Update: Federal Court Issues Revised Order Narrowing Parts Of 2017 Fiscal Code Amendments It Declared Unconstitutional

On Friday afternoon, Federal Court Judge Christopher Conner issued a revised order striking down only those portions of Act 44 of 2017, the Fiscal Code amendments, related to requiring the transfer of $200 million from the PA Professional Liability Joint Underwriting Association Fund to the General Fund to help balance the General Fund budget.

The judge said the action was taken in response to a request from the parties in the case for clarification on the scope of the original order.

The original order issued Thursday struck down all of Act 44 and the 2017 Fiscal Code amendments putting at risk funding for a variety of programs and eliminating other “riders” added to the bill to direct funding to certain programs and activities.

As a result of Friday’s action, the General Assembly and the Governor will have to find a way of dealing with just the $200 million that is suddenly not part of the budget anymore.
