DEP Invites Comments On Proposal To Issue Erosion & Sedimentation Permit For PennEast Pipeline

The Department of Environmental Protection is inviting public comments on its proposal to issue an erosion and sedimentation control permit for the PennEast Natural Gas Pipeline route (PA Bulletin page 4599).

The 77.3 mile long pipeline route travels through Luzerne, Carbon, Monroe, Northampton and Bucks counties in Pennsylvania to an existing pipeline in Mercer County, New Jersey.

In the PA Bulletin notice, DEP’s Regional Permit coordination Office said this same permit application was originally published in the February 16 PA Bulletin (page 778)  for comment with an incorrect permit number.

Any comments previously submitted in response to that PA Bulletin notice do not have to be resubmitted.

“Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department proposes to issue a permit to discharge, subject to certain limitations set forth in the permit conditions.

“These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices (BMPs) which restrict the rate and quantity of sediment discharged.”

“Following the 30-day comment period [in the August 17 PA Bulletin notice], the program manager from the appropriate Department regional office will make a final determination regarding the proposed permit.

“Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the United States Court of Appeals for the 3rd Circuit, 21400 U.S. Courthouse, 601 Market Street, Philadelphia, PA 19106-1790.”
